US Federal Court Slams EscapeX with $2.5 Lakh Penalty Over “Frivolous” Patent Lawsuit Against Google

WASHINGTON, D.C. — The US Court of Appeals for the Federal Circuit has delivered a stern warning to litigants filing meritless patent claims. In a decisive ruling, the court upheld a California district court’s order requiring mobile app developer EscapeX and its legal counsel to pay Google LLC over USD 250,000 ($2.5 Lakh) in attorney fees and sanctions.

The court found that EscapeX not only initiated a baseless patent infringement suit regarding YouTube Music but also intentionally prolonged the litigation through “frivolous” post-judgment maneuvers.


Failure to Investigate: The Core of the Dispute

The conflict began when EscapeX alleged that Google’s YouTube Music infringed on its patent for a “System and Method for Generating Artist-Specified Dynamic Albums.” However, the judicial findings revealed a series of significant lapses by the plaintiff:

  • Non-Existent Features: Google proved that the features accused of infringement did not even exist within the YouTube Music app.
  • Failed Pivot: When the initial claim faltered, EscapeX shifted its accusation to a “YouTube Video with Auto-Add” feature. Evidence showed this feature predated EscapeX’s patent priority date.
  • Lack of Pre-Suit Diligence: The District Court noted that EscapeX conducted “no serious pre-suit investigation” and instead “cobbled together” allegations from unrelated Google products.

Joint Liability for Lawyers

A significant portion of the penalty—USD 63,525—must be paid jointly and severally by EscapeX and its attorneys. This sanction was triggered by an attempt to amend the judgment using “newly discovered evidence” from witnesses who were available to the company all along.

The Appeals Court, led by Circuit Judges Taranto, Stoll, and Stark, remarked that the legal team could have avoided these sanctions “by simply not filing such a motion.”

The court affirmed three distinct orders ensuring Google was made whole for its defense costs:

  1. USD 191,302.18: Awarded for Google’s primary defense against the initial frivolous claims.
  2. Denial of Amendment: Rejection of EscapeX’s attempt to overturn the prior judgment.
  3. USD 63,525.30: Additional sanctions for the bad-faith post-judgment motion.
