These Terms and Conditions (“Terms”) govern your access to and use of the Lexibal website, its associated pages, digital tools, services, content and other initiatives operated under the Lexibal name.

By accessing or using Lexibal, you agree to these Terms. If you do not agree with any part of these Terms, please discontinue your use of the Platform.

Lexibal is an education and information platform focused on legal education, career development, academic resources, opportunities and related digital services.

Lexibal may operate different products, projects, sections, brands and services under the Lexibal name. These may include, among others:

For convenience, these initiatives and services may collectively be referred to in these Terms as “Lexibal” or the “Platform”.

Definitions

For these Terms:

“Lexibal”, “we”, “us” or “our” refers to the Lexibal platform and the person, business or legal entity operating the relevant service.

“You”, “User” or “your” refers to any person who accesses, browses or uses Lexibal.

“Content” means articles, legal notes, blogs, case summaries, judgment summaries, current-affairs material, graphics, images, videos, tools, databases, guides, listings and other material made available through Lexibal.

“User Content” means any article, note, submission, comment, image, document, opinion or other material submitted or provided to Lexibal by a user or contributor.

“Third-Party Content” means information or material originating from a person, institution, organisation or service other than Lexibal.

Use of Lexibal

Lexibal provides educational, informational and career-related resources, including legal study materials, news, opportunities, examination resources, digital tools and other related services.

You may use the Platform for lawful personal, academic, educational, professional and other legitimate purposes.

You agree not to use Lexibal for any unlawful purpose or in a manner that may damage, disrupt or interfere with the Platform or the rights of Lexibal or others.

Lexibal may introduce new services, modify existing features or discontinue particular sections or services at any time.

Educational and Legal Disclaimer

Lexibal is an educational and informational platform.

Unless expressly stated otherwise, the Content published on Lexibal does not constitute legal advice, legal opinion, legal representation or professional consultancy.

Legal information, judgments, legislation, regulations, government notifications and other legal developments may change over time. While Lexibal aims to publish useful and reasonably accurate information, we do not guarantee that all Content will always be complete, accurate, current or free from errors.

Lexibal does not guarantee:

  • Accuracy of information provided by a third party;
  • Payment of a stipend, salary or other benefit;
  • Quality or suitability of an opportunity;
  • Continuation of an opportunity after publication; or
  • Any particular result from submitting an application.

Eligibility requirements, application procedures, deadlines, fees, locations, stipends and other details may change after publication.

Users should verify the relevant details with the organisation offering the opportunity before applying or making any payment.

Lexibal may update, correct, suspend or remove an opportunity listing where appropriate.

Intellectual Property

Unless otherwise stated, original Content published by Lexibal, including its articles, notes, graphics, designs, branding, website layout, databases, tools and other original material, is owned by or licensed to Lexibal or the relevant rights holder.

Nothing in these Terms transfers ownership of Lexibal’s intellectual property to any User.

Users may access and use Lexibal Content for personal, academic and lawful purposes.

You may share links to Lexibal webpages and refer others to our Content.

You may not, without permission:

  • Republish substantial portions of Lexibal Content;
  • Present Lexibal Content as your own;
  • Copy or reproduce our Content for commercial redistribution;
  • Systematically scrape or extract Content from the Platform;
  • Create a competing database substantially based on Lexibal Content;
  • Sell, license or commercially distribute our Content;
  • Remove copyright, attribution or proprietary notices; or
  • Use Lexibal’s branding, design or other proprietary material in a manner suggesting unauthorised affiliation or endorsement.

Nothing in this section restricts rights that cannot legally be restricted under applicable law.

Lexibal Brands and Services

The names, logos, designs and identifiers associated with Lexibal and its projects, including Lexibal CLAT, CLATED by Lexibal, LegallyPresent by Lexibal, Lawfrica by Lexibal, LexNotes, LexCurrent, Lex Tools and My CLAT Journey, may constitute trademarks, brand assets or other intellectual property of Lexibal or their respective rights holders.

Users may not use these names, logos or other brand assets in a way that suggests that Lexibal has endorsed, sponsored or authorised an activity, product or service unless such permission has been expressly provided.

User-Submitted Content

Lexibal may allow users, students, contributors, authors or other individuals to submit articles, notes, research, opinions, graphics or other material.

By submitting User Content, you represent that:

  • You have the right and authority to submit the material;
  • The material does not knowingly infringe the rights of another person;
  • The material is not knowingly unlawful, fraudulent or misleading;
  • You have appropriately acknowledged material belonging to third parties where required; and
  • The submission does not knowingly contain malicious software or code.

You retain ownership of original User Content that you own.

However, by submitting User Content to Lexibal, you grant Lexibal a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, publish, display, distribute, communicate, format, edit, translate, adapt and otherwise use the submitted material for the operation, development, promotion and distribution of Lexibal and its services.

This licence may include publication through:

  • Lexibal websites;
  • Lexibal applications and digital tools;
  • Social-media accounts;
  • Newsletters;
  • Educational resources;
  • Promotional materials; and
  • Other channels operated by or on behalf of Lexibal.

The licence does not transfer ownership of your original User Content to Lexibal.

Editorial Rights

Lexibal reserves the right to review, edit, format, modify, reject, remove, update or archive User Content.

Content may be edited for reasons including:

  • Grammar and readability;
  • Formatting;
  • Accuracy;
  • Length;
  • Duplication;
  • Plagiarism;
  • Copyright concerns;
  • Inappropriate or unlawful material; or
  • Compliance with Lexibal’s editorial standards.

Lexibal is not obligated to publish every submission.

Where appropriate, contributors may be credited as authors. However, the precise format, placement and manner of attribution may be determined by Lexibal.

Accuracy of User and Third-Party Information

Lexibal may publish information supplied by users, contributors, organisations and other third parties.

Although Lexibal may review or edit such information, we cannot independently verify every statement or representation made by a third party.

Publication of third-party information does not necessarily mean that Lexibal has independently verified, endorsed or guaranteed that information.

If you identify a factual error, outdated listing or potentially infringing material, you may contact us so that we can review it.

User Conduct

You agree not to:

  • Use Lexibal for unlawful purposes;
  • Upload or distribute malicious software;
  • Attempt unauthorised access to the Platform or its systems;
  • Interfere with the security or functioning of Lexibal;
  • Impersonate another person or organisation;
  • Knowingly submit fraudulent or misleading information;
  • Infringe copyright, trademark, privacy or other rights;
  • Systematically scrape or copy Lexibal Content without permission;
  • Circumvent technical restrictions or security measures; or
  • Use the Platform in a manner that materially harms Lexibal or other users.

Lexibal may restrict or suspend access where reasonably necessary to protect the Platform, its users, its Content or its rights.

Advertisements and Commercial Activities

Lexibal may display advertisements and may participate in sponsorships, promotional arrangements, affiliate programmes, partnerships, referrals and other commercial activities.

Lexibal may receive compensation in connection with certain advertisements, promotions, referrals or sponsored content.

Where required, sponsored or promotional material may be identified accordingly.

The presence of an advertisement, listing or promotional material on Lexibal does not by itself constitute a guarantee or endorsement of the relevant third-party product, service, organisation or opportunity.

Such tools may be modified, updated, suspended or discontinued from time to time.

Unless expressly stated otherwise, digital tools are provided on an “as available” basis.

Lexibal does not guarantee uninterrupted availability, compatibility with every device or complete absence of technical errors.

Paid Services

Lexibal may offer paid products, services, subscriptions, resources, courses or other offerings from time to time.

Where a particular product or service has separate pricing, refund, cancellation or access terms, those terms will apply to that purchase.

Lexibal may change pricing, features or availability prospectively.

Nothing in these Terms creates a refund entitlement beyond what is provided under the applicable purchase terms or required by applicable law.

The Privacy Policy forms part of these Terms by reference.

Platform Availability

Lexibal aims to provide a reliable Platform but does not guarantee that the website or any particular service will always be available or uninterrupted.

The Platform may temporarily become unavailable because of maintenance, updates, technical issues, hosting problems, security measures, third-party failures, internet disruptions or circumstances beyond our reasonable control.

Lexibal may also modify, suspend or discontinue any part of the Platform.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Lexibal, its owners, operators, employees, contributors, contractors and service providers from claims, liabilities, losses, damages, costs and reasonable expenses arising from:

  • Your violation of these Terms;
  • Your unlawful use of the Platform;
  • Your User Content;
  • Your infringement of third-party rights; or
  • Your misuse of the Platform or its services.

Limitation of Liability

To the maximum extent permitted by applicable law, Lexibal shall not be liable for indirect, incidental, special, consequential or punitive losses arising from or relating to your use of the Platform.

Lexibal shall not be responsible for losses arising from:

  • Reliance on educational or informational Content;
  • Errors or omissions in Content;
  • Third-party Content;
  • Third-party websites or services;
  • Internship, job or other opportunity listings;
  • Temporary Platform unavailability;
  • Technical failures outside our reasonable control; or
  • Decisions made by Users based on information obtained through Lexibal.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

No Guarantee of Outcomes

Lexibal does not guarantee any particular academic, examination, admission, internship, employment, selection, career or professional outcome from the use of its Platform or services.

Any examples, testimonials or experiences published on Lexibal represent individual experiences and should not be understood as a guarantee of similar results.

Changes to Lexibal

Lexibal may change, update, expand, reorganise, rename, suspend or discontinue any part of the Platform or its services.

This may include changes to individual projects, brands, tools, features, content categories and digital services.

Where appropriate, important changes may be communicated through the Platform.

Changes to These Terms

Lexibal may update these Terms from time to time.

The updated version will be published on this page with a revised Effective Date or Last Updated date.

Where required by law, additional notice may be provided.

Continued use of Lexibal after the updated Terms become effective constitutes acceptance of the revised Terms.

Force Majeure

Lexibal shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, governmental actions, internet or infrastructure failures, cyber incidents, war, civil unrest, epidemics, labour disruptions or failures of third-party service providers.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be interpreted or modified to the extent legally permissible, while the remaining provisions shall continue in effect.

Waiver

A failure by Lexibal to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular product or service, constitute the agreement governing your use of Lexibal.

If service-specific terms conflict with these Terms, the service-specific terms shall prevail for that particular service to the extent of the conflict.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, disputes arising out of or relating to these Terms or your use of Lexibal shall be subject to the jurisdiction of the courts having appropriate jurisdiction in Jodhpur, Rajasthan, India.
