About IMS Unison University
The competition is organised by the Moot Court Society, School of Law, IMS Unison University, Dehradun.
The Society provides opportunities for law students to develop legal research, memorial drafting and courtroom advocacy skills. Through moot court participation, students engage with complex legal questions, strengthen their reasoning and gain practical experience in presenting legal arguments.
About the Competition
The 13th IUU Moot Court Competition offers a national platform for students to demonstrate their research, drafting and oral advocacy abilities.
The competition includes memorial preparation and evaluation, a mandatory researcher’s test, preliminary oral rounds, semi-finals and the final round. Participants will analyse a commercial technology-supply dispute and develop arguments concerning arbitration procedure, contractual obligations and liability.
Theme and Moot Proposition
The moot proposition concerns alleged defects in an electric-vehicle control system supplied under a commercial agreement. It raises questions relating to arbitration, interim relief, arbitrator independence, technical records, contractual termination and limitation of liability.
The key issues include:
- Maintainability of an application for interim measures under Section 9 of the Arbitration and Conciliation Act, 1996, after constitution of the arbitral tribunal, when relief under Section 17 is available.
- Challenges to an arbitrator’s appointment or continuation after the tribunal has rejected the challenge.
- Preservation and production of commercially sensitive technical and software records.
- Termination of a technology-supply agreement for alleged defects and the supplier’s opportunity to cure them.
- Recovery of recall expenses and postponed-launch losses under a contractual limitation-of-liability clause.
Eligibility
The competition is open to:
- Students pursuing a three-year or five-year LL.B. degree at a recognised law college or university in India.
- Students pursuing an LL.M. degree.
Participants must carry their college or university identity cards and comply with the prescribed formal courtroom dress code.
