Meaning of Section 45 CPC

Section 45 enables the provisions relating to execution of decrees to operate where execution is sought outside the territorial limits of India, in circumstances covered by the Section.

Its operation depends upon the existence of the legal framework necessary for an Indian decree to be executed in the foreign territory.

The provision must therefore be read with the relevant Central Government notification or applicable arrangement with the foreign territory.

Purpose of Section 45

A judgment-debtor may have:

  • Property outside India;
  • Assets situated in another country; or
  • A presence or business outside India.

Section 45 provides part of the statutory framework for enforcing an Indian decree in such circumstances.

Essential Requirements

For Section 45 to operate, the relevant decree and foreign territory must fall within the statutory framework contemplated by the provision.

The decree-holder must also comply with the procedural requirements governing transmission and execution outside India.

Section 45 and Section 44A

These provisions operate in opposite directions.

Section 44A: Execution in India of qualifying decrees passed by foreign courts of reciprocating territories.

Section 45: Execution outside India of decrees passed by Indian courts in circumstances covered by the provision.

Thus:

Foreign decree → India = Section 44A

Indian decree → outside India = Section 45

Practical Example

A obtains a decree from an Indian court against B. B has attachable property in a foreign territory covered by the applicable statutory arrangement.

A may seek to have the decree transmitted for execution in that foreign territory in accordance with Section 45 and the applicable legal framework.

Important Limitation

An Indian court cannot simply exercise its ordinary coercive powers over property situated in a foreign country.

Execution outside India depends upon the law and jurisdiction of the foreign territory and the applicable statutory or reciprocal arrangement.

Practical Importance in Civil Litigation

Before seeking execution outside India, the decree-holder should determine:

  • Where the judgment-debtor’s assets are situated;
  • Whether the foreign territory is covered by the applicable arrangement;
  • Whether the decree can be transmitted;
  • What documents and certification are required;
  • What procedure the foreign jurisdiction requires for enforcement.
