About the Directorate of Enforcement

The Directorate of Enforcement functions under the Department of Revenue, Ministry of Finance, Government of India. The Directorate handles matters under the Prevention of Money Laundering Act (PMLA), FEMA and FERA, with its Assistant Legal Advisers advising the offices of the Directorate on legal matters and representing it before adjudicating and appellate authorities.

About the Opportunity

The Department of Revenue, Ministry of Finance, Government of India, has invited applications from eligible candidates for filling up nine (9) vacancies in the grade of Assistant Legal Adviser of Enforcement on deputation/absorption basis in the Directorate of Enforcement.

Officers under the Central Government, State Governments, Union Territories, recognised universities, recognised research institutions, public sector undertakings and statutory or autonomous organisations are eligible to apply. Any change in the number of vacancies which may occur in due course will also be covered by the circular.

Pay Scale

The post carries Level 11 (Rs. 67,700–2,08,700) of the Pay Matrix. Officers working in the Directorate of Enforcement at the level of Assistant Legal Adviser are currently entitled to a Special Incentive Allowance at 20% of Basic Pay. Pay and allowances and other terms will be regulated in accordance with the Department of Personnel & Training’s O.M. No. 6/8/2009-Estt. (Pay II) dated June 17, 2010, as amended and revised from time to time.

Tenure

The period of deputation, including short-term contract, including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government, shall ordinarily not exceed four years. Only officers of the Central Government, State Governments or Union Territories shall be eligible to be considered for appointment on absorption basis.

Eligibility Criteria

• Holding an analogous post on a regular basis in the parent cadre or department; or
• Having five years’ service in the grade rendered after appointment thereto on a regular basis in Level-10 (Rs. 56,100–1,77,500) in the pay matrix or equivalent in the parent cadre or department; and
• A degree in law from a recognised university or institute, and three years’ experience as an advocate at the bar dealing with criminal laws or fiscal laws; or
• A master’s degree in law from a recognised university or institute, and one year’s experience as an advocate at the bar dealing with criminal laws or fiscal laws.
• The maximum age limit for appointment by deputation, including short-term contract, shall not exceed 56 years as on the last date of receipt of applications.

Roles & Responsibilities

• Process cases for filing prosecution against PMLA offenders.
• Advise offices of the Directorate on legal matters such as FERA, FEMA and PMLA when called upon to do so.
• Present cases on behalf of the Directorate before the Appellate Tribunal, Special Director (Appeals), the Adjudicating Authority constituted under PMLA and the Money Laundering Tribunal.
• Prepare para-wise comments and prepare affidavits and counter-affidavits in consultation with government counsel.
• Attend matters relating to adjudication and review of adjudication orders.
• Perform such functions as prescribed under the PMLA Manual of the Directorate and any other duty assigned from time to time by the Director of Enforcement.

Documents Required

• Bio-data along with contact number and e-mail address, in the prescribed proforma.
• Complete and up-to-date CR dossier for the last available five years, with certified photocopies.
• Vigilance Certificate/Clearance and Integrity Certificate/Clearance.
• Cadre Clearance.
• A statement of major/minor penalties, if any, imposed upon the officer during the last 10 years.
• A check list of documents to be attached with the application, in the proforma enclosed with the circular.

Application Procedure

Applications of eligible and willing officers must be forwarded by the Cadre Controlling Authorities in the proforma annexed to the circular, so as to reach the Director, Directorate of Enforcement, Block-A, Pravartan Bhawan, Dr. A.P.J. Abdul Kalam Road, New Delhi-110011. The Cadre Controlling Authorities shall verify and ensure that the particulars furnished by the applicants are correct and that no disciplinary case is pending or contemplated against the officer concerned.

Applications should reach within 45 days from the publication of the advertisement in the Employment News/Rozgar Samachar. Incomplete applications or applications received after the due date are liable to be rejected. Candidates will not be allowed to withdraw their candidature subsequently on any ground.
