Meaning of Section 73 CPC

When the property of a judgment-debtor is sold in execution and the sale proceeds are insufficient to satisfy all eligible decree-holders, Section 73 provides for rateable distribution.

Instead of allowing the first decree-holder to take the entire amount, the available proceeds are distributed proportionately among the decree-holders who satisfy the statutory requirements.

Essential Requirements

For Section 73 to apply:

  1. More than one decree-holder must have obtained decrees for payment of money against the same judgment-debtor.
  2. Those decrees must be capable of execution.
  3. The decree-holders must have made the required applications for execution.
  4. The court must have received money from the sale of property or otherwise in execution.
  5. The available amount must be insufficient to satisfy all eligible claims fully.
  6. The decree-holders must satisfy the conditions prescribed by Section 73.

How Rateable Distribution Works

The available amount is distributed proportionately according to the amounts due under the eligible decrees.

For example, suppose:

  • A is owed ₹6 lakh.
  • B is owed ₹4 lakh.
  • The court receives ₹5 lakh from execution.

The total eligible claim is ₹10 lakh. A would receive ₹3 lakh and B would receive ₹2 lakh, subject to the statutory requirements.

Purpose of Section 73

The provision promotes fairness among competing decree-holders.

It prevents one eligible decree-holder from obtaining an unfair advantage merely because the execution proceeds happened to reach that decree-holder first, where the statutory requirements for rateable distribution are satisfied.

Rateable distribution is not automatic for every decree-holder.
