Meaning of Section 41 CPC

When a decree is sent to another court for execution, the receiving court must certify to the court which passed the decree the result of the execution proceedings.

The provision creates a formal communication between the courts involved in execution.

Purpose of Section 41

Section 41 ensures that the original court is informed whether the decree has:

  • Been fully satisfied;
  • Been partly satisfied;
  • Remained unexecuted; or
  • Been otherwise dealt with during the execution proceedings.

This helps maintain an accurate procedural record of the decree.

How Section 41 Operates

The process can be understood simply:

  1. A decree is transferred for execution.
  2. The transferee court conducts the execution proceedings.
  3. The execution proceedings conclude or reach a relevant stage.
  4. The transferee court certifies the result to the court which passed the decree.

Section 41 and Section 39

Section 39 provides for transfer of a decree for execution.

Section 41 deals with what happens after execution proceedings are conducted by the transferee court.

Thus:

Section 39 → Transfer of decree

Section 41 → Certification of result

Section 41 and Section 40

Section 40 deals specifically with transfer of a decree to a court in another State.

Section 41 ensures that the result of such execution proceedings is communicated back to the appropriate court.

Practical Example

A decree is passed by a court in Delhi and transferred to a court in Jaipur because the judgment-debtor’s property is situated there.

The Jaipur court conducts execution proceedings and recovers the decretal amount. The result of the execution proceedings is then certified to the court which passed the decree.

Practical Importance in Civil Litigation

Section 41 is important for maintaining continuity between the original decree and execution proceedings conducted by another court.

A decree-holder should ensure that the execution record properly reflects:

  • The amount recovered;
  • The extent of satisfaction;
  • Any remaining balance;
  • The final result of execution.

Common Confusion

Section 41 Does Not Deal With a Fresh Execution Proceeding

It concerns the result of execution proceedings already conducted by another court.

Certification Is Different from Execution

The actual execution takes place under the applicable execution provisions. Section 41 deals with communicating its result to the appropriate court.
